TOPWEB, LLC informal summary of recent duties impacting newsprint industry

The recent increases in paper costs result from two separate preliminary duties levied by the U.S. Department of Commerce (“DOC”) and imposed on Canadian manufacturers who supply uncoated groundwood paper (including but not limited to standard newsprint and high print newsprint used in our operations) to the United States.

 

  • In January 2018, DOC levied preliminary countervailing duties on Canadian paper suppliers. DOC determined that select Canadian paper suppliers benefitted from subsidies from the Canadian government.

    • DOC final determination scheduled May 22, 2018

    • ITC final determination scheduled on or about July 6, 2018

    • Issuance of Order (if applicable) scheduled on or about July 13, 2018

 

  • In March 2018, DOC issues its preliminary dumping rates on these same Canadian entities. DOC determined that select Canadian paper suppliers were selling paper in the U.S. market for less than its fair value.

    • DOC final determination scheduled August 1, 2018

    • ITC final determination scheduled on or about September 17,, 2018

    • Issuance of Order (if applicable) scheduled on or about September 24, 2018

Each duty is preliminary, as mentioned. For each case, if DOC upholds its preliminary determination, then the U.S. International Trade Commission (“ITC”) will issue a final determination. If either the DOC’s or ITC issue a final determination that is negative, the order will be reversed.
